At 6:46 p.m. Tuesday, Rodriguez became the fourth inmate executed in Texas this year.
The appeal from Rodriguez's lawyers questioned the credibility of testimony during the trial and argued that Baldwin wasn't sexually assaulted, according to The Texas Tribune. The appeal was denied a half-hour before his execution, the Avalanche-Journal reported.
Prosecutors found evidence that Rodriguez had beaten, raped and suffocated Baldwin, who was 10 weeks' pregnant, stuffing her in a suitcase and throwing the suitcase in the trash, the Avalanche-Journal reported.
Landfill workers spotted the suitcase in September 2005 and opened it to discover Baldwin's remains inside. Testimony at Rodriguez's 2008 trial showed Baldwin may have been alive when she was stuffed in the luggage.
Using a barcode label sewn on the suitcase, surveillance video and debit card records, detectives were able to track down that Rodriguez had bought the luggage at a Walmart the day before the slaying.
