
KENANSVILLE, N.C. (WITN) - A man found guilty in a controversial arrest here in Eastern Carolina that made national news is appealing that conviction.
Anthony Wall was given probation after being found guilty in District Court of resisting arrest after a day-long trial on November 8th in Kenansville. A disorderly conduct charge was dismissed by the judge.
Wall's arrest at the Warsaw Waffle House on May 4th went viral when video showed a police officer putting his hands on the man's throat.
The SBI investigated the case but apparently found no excessive force as Officer Frank Moss was never charged. Officer Moss is now back on the job in Warsaw.
Officer Moss responded to the restaurant in Duplin County after receiving complaints that Wall had gotten into an argument with employees inside about a table that had not been cleaned off.
Attorneys for Wall say the staff had directed homophobic slurs at him.
Paperwork was filed Monday by Wall's attorney in appealing the conviction to Superior Court. They are asking for a jury trial, while no date has yet been set.
