One of the victims is claiming damages of over three million euros
The plaintiff never actually lived with her ‘birth’ parents and her grandmother took over her care. The case came to light when her guardian demanded maintenance money from the father, and a DNA test revealed that the two weren’t actually biologically related. A subsequent test confirmed that she bore no relationship to her mother, either.
A follow-up investigation uncovered the fact that the woman’s registered blood group wasn’t accurate, and the only possible explanation was that the other baby girl, born around the same time, was involved. Another anomaly discovered during the course of proceedings was that the birth weights of both babies didn’t add up.
Once the mistake had been verified, regional health authorities offered a settlement of 215,000 euros, but the plaintiff is now suing for more than three million euros. The regional minister for health, Sara Alba, has acknowledged that the babies were given to the wrong families but insists that it was a case of human error; however, the plaintiff’s lawyers have argued that the damage caused by the switch is ‘immeasurable, continuous and for life.’
The young woman is now awaiting further genetics tests to determine the identity of her real parents.
For its part, the Ministry of Health has vowed that such an extraordinary mistake will never be made again, since hospital systems have now been computerised and that it is ‘practically impossible for something like this to happen again today.’
