Hearing a Bail Case, CJI Asks, 'Today Lord Krishna Was Born in Jail. Do You Want to Leave Jail?' - The Wire

New Delhi: “You want bail or jail? Today Lord Krishna was born in jail. Do you want to leave jail?”

On August 11, which was observed as Janmashtami, Chief Justice of India S.A. Bobde asked this question to an applicant while hearing a case.

The bail plea was filed by one Dharmendra Valvi, who was convicted and sentenced to life imprisonment for murder. CJI Bobde asked the question on the Hindu festival of Janmashtami, the birth of Lord Krishna, to the lawyer of the petitioner during the hearing in his court.

When the lawyer said he was seeking bail for his client, the CJI replied, “Good. Religion is not something you are extremely attached to.”

According to a Hindustan Times report, Dharmendra was a Congress party member. He, along with five other party workers, was charged with murdering a political opponent from the BJP in 1994.

All six were found guilty by a trial court in Maharashtra, which was upheld by the Bombay high court in September 2017. The appeal against the high court order has been pending with the Supreme Court.

The CJI later granted bail to the petitioner, stating, “During the pendency of the main appeal, the appellant, Dharmendra Valvi, is directed to be released on bail on furnishing bail bonds in the sum of Rs.25,000 with two sureties of the like amount.”
